Manslaughter Defined

The killing of another individual by an intentional act (intentionally committing the act which resulted in the victims death) or by culpable negligence.

Involuntary manslaughter is causing the death of someone unintentionally, typically while engaged in reckless behavior such as drinking that a reasonable person would assume could cause harm.

Voluntary manslaughter is killing due to ‘reasonable provocation,’ such as if you are involved in an argument, defending yourself in a fight, are being coerced or are under stress. 

Common Penalties

Both voluntary and involuntary manslaughter are felonies that can carry serious penalties. Unintentional, involuntary manslaughter while driving under the influence carries particularly heavy penalties. 

At least 3 years in prison and up to 20 years for voluntary manslaughter

Victim restitution

10-16 months in prison or more for involuntary manslaughter

20 years in state prison;15 year loss of license; $25,000 fine for vehicular manslaughter
