THE PENALTIES FOR DRUG POSSESSION & TRAFFICKING

Penalties for possession of a CDS depend on the class of the drug and whether it is a first offense or a subsequent offense.

Penalties for possession may include the following, and more:

  • Revoked driver’s license
  • A fine ranging from $500 to $5,000
  • Anywhere from six months in jail to five years in state prison
  • Drug trafficking is a felony, with severe penalties and lifelong consequences. Trafficking a Class A controlled substance such as heroin can result in a prison sentence of up to 20 years. In cases where a defendant uses violence or a threat of violence with a firearm, or helps a minor distribute drugs, the penalties can be increased so defendants become ineligible for parole.
